On April 7, 2020, NTCA filed comments with the FCC in support of a Petition for Preemption of several Missouri cities’ imposition of duplicate right-of-way (“ROW”) fees upon a telecom provider and the owner of the network used by the provider. In the filing, NTCA supported the network owner and provider’s argument that charging a ROW fee upon both entities for the same network violates the Communications Act by materially inhibiting the provider’s ability to provide service due to the duplicative cost of accessing the same ROW for the same network.
