(November 18) In response to an FCC Notice of Inquiry, NTCA suggested steps the agency can take to promote timely and cost-effective access to state and local government-controlled rights-of-way (“RoWs”) for the purpose of installing wireline infrastructure. NTCA stated that the FCC has legal authority to take these suggested steps using Section 253 of the Communications Act based on previous agency action upheld by a federal court.
