(Jun 28) Responding a Viasat Application for Review, NTCA argued that a Commission staff decision to reject the satellite provider’s application to bid a low-latency, low-Earth orbit (“LEO”) service in the Rural Digital Opportunity Fund Phase I auction should be upheld. The FCC staff decision was consistent with the agency’s delegated authority rules, the Administrative Procedure Act and the safeguarding of limited universal service funding.
