NTCA Files Amicus Brief Challenging Court Opinion Finding ISP Liable for Subscribers’ Copyright Infringement

(Jun 2) NTCA joined other associations in a brief submitted to the U.S. Court of Appeals for the Fourth Circuit on June 1, 2021, challenging the lower court’s $1 billion judgment against Cox Communications for copyright infringement.  The brief argued that ISPs operating solely as conduits for subscribers’ internet access do not have the ability to remove or block access to any material alleged to infringe a copyrighted work, with their only recourse being to disconnect the subscriber whose IP address is identified on a notice of infringement sent to the ISP by a copyright owner.
