(Sept 22) In comments filed at the FCC, NTCA supported a petition filed by a Missouri company seeking preemption of a locality’s assessment of excessive rights-of-way fees. The petition argued that the fees at issue are unrelated to the locality’s cost of granting access to such public rights-of-way, and NTCA commented that the practices imposed by the locality would have a chilling effect on other providers seeking to offer competitive broadband services, perhaps most especially small providers.
